Jury in Apple case: You can patent cool

After a year of scorched-earth litigation, a U.S. jury decided Friday that Samsung ripped off the innovative technology used by Apple to create its revolutionary iPhone and iPad.

Yes, you can patent the cool factor. That was the message of the nine-member jury that took just three days to reach a verdict in the?landmark Apple-Samsung patent infringement battle.

After a three-week trial, the jury concluded Friday that Samsung had willfully violated Apple patents, copying the look and feel of the massively popular iPhone and iPad in its own smartphone and Tablet devices. Samsung came up empty in its cross-claims against Apple and was ordered to pay $1.05 billion in damages.

Although Samsung suggested it would appeal, saying the jury ruling was "not the final word in this case," Samsung devices could be pulled from the U.S. market soon as Apple said it will seek an injunction at a Sept. 20 hearing. The decision was a blow to Google, whose Android operating system powers Samsung's devices, which generally sell at a discount to comparable Apple products.

Apple's late CEO Steve Jobs had threatened to go "thermonuclear" on Google over its perceived theft of Apple's intellectual property, according to Job's biographer, and new CEO Tim Cook has continued to aggressively press the legal battle around the world.

The federal court jury agreed with Apple's claims that not only was it able to protect the distinctive design of its products but also technology such as the ability of users to "pinch-and-zoom" to manipulate images using two or more fingers on device touchscreens.

Intellectual property experts said the decision will push?push smartphone and tablet manufacturers to come up with new ideas ? and patent them all.

"Every single technology company in the world will be filing every single design patent known to man,"?said?Kevin G. Rivette, managing partner at 3LP Advisors.

While the decision will almost certainly be appealed, it also sets a precedent. It is a shot across the bow that other device manufacturers can?t afford to ignore.

Apple had a less favorable outcome in Samsung's home country of South Korea, where a three-judge panel ruled earlier Friday that both companies had infringed on each other and halted sales of products made by Apple as well as Samsung.

Apple was widely favored to come out on top in the case decided today, partly because the court?s Silicon Valley location is friendly territory for the Cupertino-based company, and also because of the disparity between the way the two sides presented their arguments.

As the plaintiff, it was in Apple?s best interest to make its message easy to digest. For a company that built its brand on making technology simple and pleasant to interact with, this was a natural. Samsung had the burden of wading into more complex territory and hoping jurors would follow along.

That Apple carried the day indicates that its streamlined message resonated more strongly, because patent experts say that design patent infringement, for which Apple was seeking the largest damages, is hard to prove. These patents focus on form over function: how something looks as opposed to what it does.

Apple took the bold and risky tack of arguing that the way its devices look and feel is an integral part of how people use them. Other smartphone and tablet makers now have to find ways to create devices that don?t resemble the iPhone ? no easy feat, given that Apple more or less created the idea in people?s minds of what a smartphone should look like when it debuted the iPhone five years ago.

"It will force innovation," Rivette said, a circumstance that might cause some heartburn for smartphone and tablet manufacturers but will ultimately benefit consumers.?

CNBC's Jon Fortt reports from outside the courtroom following the jury's verdict. Apple was awarded more than $1 billion and had many of its patents upheld.

Aside from Apple, the jury's decision creates a few other unlikely winners, including Microsoft, for one. Analysts have said for months that Microsoft must convince consumers that Windows 8 offers a relevant alternative to iOS and Android. The sudden interest in devices that don?t behave like iPhones and iPads coincides almost perfectly with the platform?s debut.

Rivette said the verdict will invigorate technology patent wars, which means companies like Google ? which has been in Apple?s crosshairs before and almost certainly will be again ? will be scrambling for ammunition. Former tech heavyweights Research in Motion and Eastman Kodak both have vast patent portfolios that suddenly look like a good investment in light of the $1 billion award for damages.

MINNEAPOLIS, Aug. 25 (UPI) -- Nick Novak kicked a 45-yard field goal on the final play of the game Friday to give the San Diego Chargers a 12-10 exhibition decision over Minnesota.

The Vikings took a 10-9 lead with 1:54 to play on a 1-yard pass from Sage Rosenfels to Matt Asiata, the game's only touchdown.

San Diego then marched 53 yards in nine plays and Novak produced his second field goal of the night.

Nate Kaeding kicked field goals of 50 yards in the first period and 54 yards in the fourth for the Chargers.

San Diego's Charlie Whitehurst completed 8-of-18 passes for 82 yards as quarterback Phillip Rivers and tight end Antonio Gates sat out the contest.

The Chargers improved to 3-0 in the exhibition season and Minnesota is 1-2.

Deadly shooting near the Empire State building

Eight people are believed to be wounded and at least two people are dead Friday after a shooting outside the Empire State Building in the Midtown area of Manhattan. The two victims include the gunman, who was shot and killed by police near the tourist entrance of the landmark skyscraper.

The shooting occurred at around 9 a.m. ET at Fifth Avenue and West 34th Street. The New York Post reported that the incident was the result of a co-worker dispute; the gunman was fired from his job on Thursday and returned to his office today to target his boss, local and federal officials told NBC News, according to a tweet. The gunman, who was shot by police at the scene, and a bystander are both dead.

The shooter followed his coworker down 33rd Street, and shot him outside of Legend's Bar, the Post reported. It is unclear if he fired into a crowd of pedestrians outside of the landmark building, or if pedestrians were caught in crossfire, reported the New York Daily News.

The number of fatalities has not been made official. Mayor Michael Bloomberg has scheduled a press conference for 11 a.m. ET.

Police cordoned off a one-block perimeter around the Empire State Building after the shooting. Around 10 a.m., a lone tourist bus headed down Fifth Avenue, and a guide could be heard over the bus's mic explaining they were nearing the landmark. As police waved the bus to detour down 36th Street, the guide was openly mystified. "I don't know what's going on, folks," he said, as the bus turned. By then the bus's passengers were looking up at the sky at a news helicopter floating overhead. Some stood, clutching their cameras.

Along 35th street, hundreds of people stood photographing the scene with iPhones and iPads. Officers could be seen standing in the middle of 34th street around a scene surrounded by police tape. Television producers roamed the crowd looking for witnesses. "Was anybody here when this happened? Was anybody here when this happened?" one NBC producer yelled.

Eyewitnesses told CNN that the gunman was using a rifle or shotgun.

Word of the shooting spread rapidly on social media networks.

"On 5th avenue surrounded by helicopters and police," @CeciliaHalling wrote on Twitter. "I'm very glad I wasn't 20 blocks further down half an hour ago."

The Affordable Care Act's ?Penalty?: If You Don't Buy Health ...

Note to readers; a longer version of this post originally appeared on HealthInsurance.org, along with a penallty calculator.

Despite the hullabaloo about the Affordable Care Act?s mandate that nearly everyone puchase heath insurance in 2014?or pay a penalty?the Congressional Budget Office estimates that only 1.4 percent of Americans will wind up paying the tax.

That is because the vast majority of us either have health insurance, or are exempted from the mandate for any one of a number of reasons.? For example, at the end of 2014?you will?owe no tax if:

• your income is low enough that your share of premiums (after federal subsidies and employer contributions) would total more than 8 percent of your income;
• your income is below the income tax filing threshold, and so you?re not required to?file taxes;
• you were uninsured for less than three months of the year (If over three, the penalty is pro-rated);

As a result the Urban Institute?estimates that just 6??percent of the population (roughly 18 million Americans) will even have to consider the question: ?Should I purchase health insurance, or pay a tax?? That?s right: a whopping 94 percent of the population will?have no reason to worry about paying a penalty.

And 11 million of that 18 million will be low-income or middle-income Americans who are eligible for a government subsidy to help cover the cost of their premiums. Chances are, most of them will take the government up on its offer.?

That still leaves about 7 million Americans who?are uninsured today and won?t qualify for a?subsidy. ?But many of them lack coverage because they suffer from a pre-existing condition.? As a result,??most insurers won?t sell them a policy, and those?who will cover them demand sky-high premiums.??Under the ACA, insurers will no longer be able to shun the sick;?nor will they be able?to charge them more.

If You Decide to Gamble, And Go Without Insurance, How Much Will You Pay?

Inevitably, some people will decide not to buy comprehensive insurance because they?re healthy and wealthy enough that they feel they can cover their own?medical expenses. Others wil refuse to purchase a policy as a matter of principle: some Americans just don?t like the? insurance?industry, and resent being told they should buy their products.?

The size of the tax they pay will depend on how many people are in their household, and how much they earn.In? 2014 an individual who earns $35,000 and chooses to opt out will owe just $95? though if he?earns $250,000, he?ll wind up paying $2,500 or roughly 1% of adjusted gross income above $9,500.? (The tax applies only to income above and beyond the filing threshhold; in 2011 that was $9,5000 for most singles and $19,000 for most married couples. )

?Over the next two years, the penalty rises. In 2016, a middle-income family of four earning $60,000 would?owe about $2,085 ? still far less than the?tax a more affluent family would pay. (For example, a household reporting?adjusted gross income of ?$200,000?would owe?roughly?$4,300. In other words, this is a progressive tax

But there is a cap on how much any household will owe: according to the law the tax cannot exceed the national average premium for ?bronze level? health plans offered through exchanges. These bronze plans will? cover 60 percent of? medical expenses, and the Congressional Budget Office (CBO) estimates that in 2016 the average premium would be about $4,750 for single policies and $12,250 for family policies. (This sounds expensive, but keep in mind?that??middle-class? Americans?who don?t have employer-based insurance will receive subsidies from government to help cover the cost. For example, a family of three earning?$54,930?would end up?paying just $5,218 for a ?silver? plan that covered 70% of?the family?s ?medical expenses.

Why is the penalty so high? Because if a healthy wealthy?person decides?to opt out?and then later becomes sick? he will be able to change his mind and buy insurance. The point of?the Affordable Care Act is?to make sure that everyone has access to healthcare; no one will be barred from the system.? At the same time, it?s not fair to let someone wait until they are sick before entering the insurance pool while others have been paying into that pool for years.? So those who choose not to buy coverage will pay penalties in lieu of premiums ?and those taxes will keep?our heatlh care system afloat.

BLOOMFIELD HILLS, Mich. (AP) ? It's safe to say that until recently, Republican Paul Ryan had never visited a lemonade stand with a dozen Secret Service agents in tow. And he almost certainly hadn't discussed the tightness of his shirts during a national radio interview. Or been asked to play "word association" by a TV reporter.

It's a whole new world for the Wisconsin congressman.

In ways large and small, life has changed for Ryan in the two weeks since Mitt Romney named him as running mate. Before that, Ryan was an up-and-coming but little-known House member still untested on the national stage.

Now, he's a GOP vice presidential hopeful whose days are a blur of rallies, fundraising events, local television interviews and plane flights, during which he reads news accounts of the campaign and pores over policy briefing papers on his iPad. Some things, of course, haven't changed. He still adheres to a strict exercise regimen each morning ? only these days, he does cardio in the hotel fitness center or works out in his room, instead of the House gym. A single Miller Lite in the evening is his only indulgence.

"Everybody said this would drain me, the road, but it's not. It's great. It actually gives you energy," Ryan told reporters this week on a flight from Virginia to North Carolina, one of a handful of excursions he's made to the press cabin on his plane.

As he campaigns across battleground states in the days leading up to the Republican National Convention, Ryan draws large crowds at his events and is a natural onstage, often appearing more comfortable than Romney before an audience and delivering the campaign's talking points with ease. At a fundraiser in Springfield, Mo., this week, Ryan lent a human touch to the Romney campaign's oft-repeated claim that President Barack Obama likes to promote class warfare by attacking the former Massachusetts governor's wealth.

"When I was a kid growing up working at McDonald's, de-tasseling corn, waiting tables, painting houses, things like that, it never occurred to me that I was stuck in some station, fixed in some class," Ryan told donors. "We shouldn't be preying on people's emotions of fear, envy and anxiety, putting people in a class, dividing people. That's why I don't think this going to work for President Obama."

Ryan also has shown that he knows how to stir up a local crowd.

At a rally in Pittsburgh, he waved a "terrible towel" ? the fan prop of the Pittsburgh Steelers football team, even though Ryan himself is a die-hard Green Bay Packers supporter. And after a fundraiser in Raleigh, N.C., Ryan purchased a beverage from a group of neighborhood kids running a lemonade stand as his security detail hovered close by.

To be sure, Ryan does what many politicians do, indulging in the same sorts of verbal sleights of hand.

He criticizes pending defense cuts even though he supported a House budget agreement that would allow such cuts to take place. And Ryan blames Obama for excess spending and government debt even though he voted in favor of several spending programs pushed by former Republican President George W. Bush that helped explode the federal deficit, such as the Medicare prescription drug plan.

Ryan largely avoids national news outlets in favor of local interviews in the most competitive states, in part to reach undecided voters in those states but also to avoid the kind of grilling from national reporters that might take him off message. In Roanoke, Va., he told a reporter for a local outlet that he preferred asparagus to cake and agreed to a session of "word association" that produced a question about fast-food chain Chick-fil-A, which had become the focus of controversy over gay marriage.

"Good chicken," Ryan said.

But the local vs. national press strategy doesn't always work.

Ryan found that out when parrying tough question from a Pittsburgh reporter about his views on abortion and rape in the wake of comments by Rep. Todd Akin, the Missouri Senate candidate who stirred a firestorm when he asserted that victims of "legitimate" rape can physically resist pregnancy.

"Should abortions be available to women who've been raped?" KDKA reporter Jon Delano asked Ryan, who has co-sponsored tough anti-abortion legislation with Akin.

Ryan responded: "Rape is rape."

When he has allowed national outlets to interview him, he's tended to stick to conservative-friendly hosts like Sean Hannity and Laura Ingraham, who asked Ryan about a host of issues ? including his clothing choices on the road.

"You went from very boxy clothes to the slim fit," Ingraham said. "Those shirts are a little tighter than the usual Paul Ryan shirts. The girls at our studio notice."

"Some of 'em are big and some of 'em fit real well," Ryan said.

Ryan's visits to reporters on his plane have been rare but memorable. He came bearing cookies on one occasion and came another time to bid farewell to a reporter decamping to Vice President Joe Biden's campaign. Reporters thrust microphones in his face each time to pepper him with questions.

"Every time I come back here, are you guys going to always do that?" he asked. "Does it have to be so formal?"

Rumor is that Apple will hold a very special event on Sept. 12. The general assumption is that Apple will announce the next-generation iPhone and a smaller iPad, but now some are suggesting that the Cupertino-based company will wait until October to talk about what's being dubbed the "iPad Mini" or "iPad Air."

Let's be clear: We don't actually know if Apple is even working on a smaller iPad. All we have to go on are reports from anonymous sources and leaked?parts which are?allegedly?intended for this tablet. There's currently ?no official word from Apple confirming the existence of the iPad Mini. But where there's smoke, there's occasionally a fire.

Tech blogger/Apple watcher John Gruber ? who has a good track record when it comes to reasoning out details ? seems convinced that the smaller tablet is coming, but not until October.?

"I don?t think Apple would want reviews of both a new iPhone and new-size iPad appearing at the same time," Gruber?writes. "The iPhone is too big, too cool, and garners too much attention ? and it?s in Apple?s interest to keep that attention undiluted."

Instead of having two new devices share the stage in September, Apple will likely use the first or second week of October ??when it typically holds a music-themed event ??to unveil the new iPad (and perhaps some new iPod devices), Gruber speculates.?Jim Dalrymple, another well-connected tech writer and?Apple follower with a solid track-record on rumors,?is nodding along.?

"Oh, that Gruber is a smart fellow," he simply adds.

He didn?t seem to have any interests outside of school and his grades were not good. I asked him ?Why don?t you do any extracurricular activities?? I almost fell out of my chair when he answered, ?That would take effort.?

After our conversation, I began to think about some of the similar problems of struggling teenagers and those of struggling information marketing entrepreneurs.

There are two things I believe are stopping some people from having the successful online business they want to create in their life:

1. Lack of Results-Oriented Effort

Teenager ? Many teenagers live with an entitlement attitude. They believe simply because they exist or did a minimum amount of effort, they deserve things they have not earned.

Struggling Entrepreneur ? Same thing with many internet marketers. There is a world of difference between planning the actions you will take and actually taking the action once you?ve made your plans and getting things done. Many people delude themselves into thinking that planning things in their head is enough and never get into the small, daily, consistent, unsexy actions that would yield results.

Solution: Stop looking for the magic pill. It does not exist. And even seemingly ?magic pills? have unwanted side effects. Effort and energy is required to be a success in anything. Creating the habit of sustained effort and action-taking starts with planning but does not end there. Make sure you follow through on those plans until you?ve developed a huge action-taking muscle in your online business. On a regular basis, look back and evaluate the results you?re getting from those actions.

2. Lack of Personal Experience

Teenager ? Teenagers have little or no experience in many of life?s obstacles and gaining that firsthand experience is what turns them into productive, healthy, well rounded adults.

Struggling Entrepreneur ? In the same way, many people who want to start an information marketing business want to teach subjects they have absolutely no experience or success in! You simply cannot teach abundance and prosperity if you are living paycheck to paycheck. You cannot teach inner peace if you send angry, reactive emails and can?t control your temper with your family.

Solution: Teach only what you truly know. Do not attempt to teach what you do not have experience in. You cannot help people and you will not be successful. Gain the experience necessary to become a great teacher by finding a coach or mentor who has been successful in that area. Then, you got it?!
