'Fiscal cliff' disputes remain as deadline nears

(AP) ? The White House and Senate Republicans sorted through stubborn disputes over taxing the wealthy and cutting the budget to pay for Democratic spending proposals as Monday's midnight deadline for an accord avoiding the "fiscal cliff" drew to within hours.

Senate Minority Leader Mitch McConnell, R-Ky., spoke repeatedly Sunday to Vice President Joe Biden, a former Senate colleague, in hopes of settling remaining differences and clinching a breakthrough that has evaded the two sides since President Barack Obama's November re-election. In one indication of the eleventh-hour activity, aides said the president, Biden and top administration bargainer Rob Nabors were all working late at the White House, and McConnell was making late-night phone calls as well.

Unless an agreement is reached and approved by Congress by the start of New Year's Day, more than $500 billion in 2013 tax increases will begin to take effect and $109 billion will be carved from defense and domestic programs. Though the tax hikes and budget cuts would be felt gradually, economists warn that if allowed to fully take hold, their combined impact ? the so-called fiscal cliff ? would rekindle a recession.

"There is still significant distance between the two sides, but negotiations continue," Senate Majority Leader Harry Reid, D-Nev., said shortly before the Senate ended an unusual Sunday session. "There is still time to reach an agreement, and we intend to continue negotiations."

The House and Senate planned to meet Monday, a rarity for New Year's Eve, in hopes of having a tentative agreement to consider. Yet despite the flurry of activity, there was still no final pact.

And in a move that was sure to irritate Republicans, Reid was planning ? absent a deal ? to force a Senate vote Monday on Obama's campaign-season proposal to continue expiring tax cuts for all but those with income exceeding $200,000 for individuals and $250,000 for couples.

Attached to the measure ? which the GOP seemed likely to block ? would be an extension of jobless benefits for around 2 million long-term unemployed people. The plan was described by Sen. Richard Durbin of Illinois, the chamber's No. 2 Democrat.

The House and Senate met Sunday ready to debate an agreement or at least show voters they were trying. But the day produced alternating bursts of progress and pitfalls, despite Senate chaplain Barry Black's opening prayer in which he asked the heavens, "Look with favor on our nation and save us from self-inflicted wounds."

In one sign of movement, Republicans dropped a demand to slow the growth of Social Security and other benefits by changing how those payments are increased each year to allow for inflation.

Obama had offered to include that change, despite opposition by many Democrats, as part of earlier, failed bargaining with House Speaker John Boehner, R-Ohio, over a larger deficit reduction agreement. But Democrats said they would never include the new inflation formula in the smaller deal now being sought to forestall wide-ranging tax boosts and budget cuts, and Republicans relented.

"It's just acknowledging the reality," Sen. Susan Collins, R-Maine, said of the GOP decision to drop the idea.

There was still no final agreement on the income level above which decade-old income tax cuts would be allowed to expire. While Obama has long insisted on letting the top 35 percent tax rate rise to 39.6 percent on earnings over $250,000, he'd agreed to boost that level to $400,000 in his talks with Boehner. GOP senators said they wanted the figure hoisted to at least that level.

Senators said disagreements remained over taxing large inherited estates. Republicans want the tax left at its current 35 percent, with the first $5.1 million excluded, while Democrats want the rate increased to 45 percent with a smaller exclusion.

The two sides were also apart on how to keep the alternative minimum tax from raising the tax bills of nearly 30 million middle-income families and how to extend tax breaks for research by business and other activities.

Republicans were insisting that budget cuts be found to pay for some of the spending proposals Democrats were pushing.

These included proposals to erase scheduled defense and domestic cuts exceeding $200 billion over the next two years and to extend unemployment benefits. Republicans complained that in effect, Democrats would pay for that spending with the tax boosts on the wealthy.

"We can't use tax increases on anyone to pay for more spending," said Sen. Kay Bailey Hutchison, R-Texas.

Both parties also want to block an immediate 27 percent cut in reimbursements to doctors who treat Medicare patients. Republicans wanted to find savings from Obama's health care bill as well as from Medicare providers, while Democrats want to protect the health care law from cuts.

Both sides agree that a temporary 2-percentage-point cut in the Social Security payroll tax was likely to expire. That reduction ? to 4.2 percent ? was initiated by Obama two years ago to help spur the economy and has meant $1,000 annual savings to families earning $50,000.

A senior defense official said if the spending cuts were triggered, the Pentagon would soon begin notifying its 800,000 civilian employees to expect furloughs ? mandatory unpaid leave, not layoffs. It would take time for the furloughs to be implemented, said the official, who requested anonymity because the official was not authorized to discuss the preparations

A. The enforceability of most noncompetition agreements and similar restrictions on post-employment competition generally depends on the common law or statutes of the state in which an employee lives and works, or the law chosen in an employment agreement.

Unlike Minnesota, California and certain other states? common law or statutes prohibit nearly all employee noncompetition agreements. There is, however, a potential option to incentivize employees not to compete, by using certain compensation plans regulated by federal law rather than any state?s.

The Employee Retirement Income Security Act (ERISA) is the federal law that regulates certain em??ployee benefits such as health plans and pension plans. Cer??tain deferred compensation plans regulated by ERISA and related to more highly compensated employees, may contain forfeiture-for-competition provisions. Those provisions state that employees forfeit later payments of deferred compensation if they have competed with the company after their employment ends.

One advantage to these forfeiture-for-compensation provisions is that ERISA pre-empts state laws. That means California?s and other states? laws prohibiting noncompetition agreements do not apply to their enforcement.

Of course, these plans may not be right for all employers, and they must be drafted to meet ERISA re??quire??ments. Under certain circumstances they can create a significant incentive for employees not to compete after they leave the company.

UK "X Factor" winner regains top chart spot

LONDON (Reuters) - James Arthur, winner of this year's British version of the "X Factor" TV talent show, saw his debut single climb back to number one in the British pop charts on Sunday.

Arthur's "Impossible" shot straight to the top earlier this month but was overtaken last week by a tribute song to the victims of the 1989 Hillsborough football stadium disaster, "He Ain't Heavy, He's My Brother", a version of the ballad that was a worldwide hit for The Hollies.

That song has now slipped to fifth position, according to the Official Charts Company listings.

"Scream and Shout" by will.i.am, featuring Britney Spears, stayed at two while Psy's monster video hit "Gangnam Style" was up three places to third.

In the album charts, British singer Emeli Sande stayed top with "Our Version Of Events", with Olly Murs' "Right Place, Right Time" unchanged at two.

US embassy evacuated in Central African Republic

As rebels approached the capital of the embattled Central African Republic, the U.S. shuttered its embassy and moved out its ambassador and about 40 diplomats, the Guardian of London reported.

?This decision is solely due to concerns about the security of our personnel and has no relation to our continuing and long-standing diplomatic relations with the (Central African Republic),? read a statement posted Friday to the embassy?s website.

The Seleka rebels seized the city of Sibut about 114 miles from Bangui, the capital, a government official confirmed to The Associated Press. Sibut, a transportation hub, fell to the rebels without a shot fired because the government army had pulled back on Friday.


The rebels accuse President Fran?ois Boziz? of not meeting terms of a 2007 peace agreement, according to The New York Times. Meanwhile, Boziz?, who grabbed power in 2003 and has since been twice elected president, has pleaded for international help, appealing to the French in particular. The French government, the former colonial power, has refused to step in.

The Central African Republic, with a population of about 4.4 million, is landlocked between other politically stable countries at the heart of the continent has a population. President Barack Obama sent about 100 special operations troops to the region in April to hunt down Joseph Kony, the rebel leader of the notorious Lord?s Resistance Army and the subject of a widely viewed, 30-minute documentary, Kony 2012.

Doctors Without Borders said in a statement this week that clashes between rebels and the army have forced residents to leave their homes ? disrupting their missions to bring medical care to the region.

?This situation could have fatal consequences for people already struggling to find care after a decade of chronic armed violence had severely limited the country?s health system,? the statement said. Doctors Without Borders, which has had a presence in the region since 1997, says that malaria is the main focus of its projects there.

Enoch Nodl-ya, a nurse anesthetist for Doctors Without Borders, provided a medical perspective on other issues faced:

For the last 10 years the population has endured the regular presence and attacks from armed men in this region. People are scared and flee rapidly into the bush. As a consequence, many women give birth in the fields without any assistance and most sick or wounded are hesitant to receive medical assistance, scared of possible violence in the populated areas. When the violence stops, we often see patients coming in an advance stage of their diseases.

7. Moroccan Bean Stew. If you are having a cozy, homey New Year?s Eve and want a soup, this is one of my favorites. It is special and elegant enough to serve to guests, and is also delicious paired with breads with the Truffled Cashew Cheese from LTEV.

Analysis: For Senate leaders, a mission impossible from Obama

WASHINGTON (Reuters) - Following a Friday meeting with congressional leaders, an impatient and annoyed President Barack Obama said it was "mind boggling" that Congress has been unable to fix a "fiscal cliff" mess that everyone has known about for more than a year.

He then dispatched Senate Majority Leader Harry Reid, a Democrat, and Minority Leader Mitch McConnell, a Republican, on a mind-boggling mission: coming up with a bipartisan bill to break the "fiscal cliff" stalemate in the most partisan and gridlocked U.S. Congress of modern times - in about 48 hours.

Reid and McConnell, veteran tacticians known for their own long-running feud, have been down this road before.

Their last joint venture didn't turn out so well. It was the deal in August 2011 to avoid a U.S. default that set the stage for the current mess. That effort, like this one, stemmed from a grand deficit-reduction scheme that turned into a bust.

But they have never had the odds so stacked against them as they try to avert the "fiscal cliff" - sweeping tax increases set to begin on Tuesday and deep, automatic government spending cuts set to start on Wednesday, combined worth $600 billion.

The substantive differences are only part of the challenge. Other obstacles include concerns about who gets blamed for what and the legacy of distrust among members of Congress.

Any successful deal will require face-saving measures for Republicans and Democrats alike.

"Ordinary folks, they do their jobs, they meet deadlines, they sit down and they discuss things, and then things happen," Obama told reporters. "If there are disagreements, they sort though the disagreements. The notion that our elected leadership can't do the same thing is mind-boggling to them."

CORE DISAGREEMENT

The core disagreement between Republicans and Democrats is tough enough. It revolves around the low tax rates first put in place under Republican former President George W. Bush that expire at year's end. Republicans would extend them for everyone. Democrats would extend them for everyone except the wealthiest taxpayers.

The first step for Reid and McConnell may be to find a formula acceptable to their own parties in the Senate.

While members of the Senate, more than members of the House of Representatives, have expressed flexibility on taxes, it's far from a sure thing in a body that ordinarily requires not just a majority of the 100-member Senate to pass a bill, but a super-majority of 60 members.

With 51 Democrats, two independents who vote with the Democrats and 47 Republicans, McConnell and Reid may have to agree to suspend the 60-vote rule.

Getting a bill through the Republican-controlled House may be much tougher. The conservative wing of the House, composed of many lawmakers aligned with the Tea Party movement who fear being targeted by anti-tax activists in primary elections in 2014, has shown it will not vote for a bill that raises taxes on anyone, even if it means defying Republican House Speaker John Boehner.

Many Democrats are wedded to the opposite view - and have vowed not to support continuing the Bush-era tax rates for people earning more than $250,000 a year.

Some senators are wary of the procedural conditions House Republicans are demanding. Boehner is insisting the Senate start its work with a bill already passed by the House months ago that would continue all Bush-era tax cuts for another year. The Democratic-controlled Senate may amend the Republican bill, he says, but it must be the House bill.

For Boehner, it's the regular order when considering revenue measures, which the U.S. Constitution says must originate in the House.

SHIFT BLAME

As some Democrats see it, it's a way to shift blame if the enterprise goes down in flames. House Republicans would be able to claim that since they had already done their part by passing a bill, the Senate should take the blame for plunging the nation off the "cliff."

And that could bring public wrath, currently centered mostly on Republicans, onto the heads of Democrats.

Voters may indeed be looking for someone to blame if they see their paychecks shrink as taxes rise or their retirement savings dwindle as a result of a plunge in global markets.

If Reid and McConnell succeed, there could be political ramifications for each side. For example, a deal containing any income tax hikes could complicate McConnell's own 2014 re-election effort in which small-government, anti-tax Tea Party activists are threatening to mount a challenge.

If Obama and his fellow Democrats are perceived as giving in too much, it could embolden Republicans to mount challenge after challenge, possibly handcuffing the president before his second term even gets off the ground.

It could be a sprint to the finish. One Democratic aide expected "negotiation for a day." If the aide is correct, the world would know by late on Saturday or early on Sunday if Washington's political dysfunction is about to reach a new, possibly devastating, low.

If Reid and McConnell reach a deal, it would then be up to the full Senate and House to vote, possibly as early as Sunday.

Reid and McConnell have been through bitter fights before. The deficit reduction and debt limit deal that finally was secured last year was a brawl that ended only when the two leaders agreed to a complicated plan that secured about $1 trillion in savings, but really postponed until later a more meaningful plan to restore the country's fiscal health.

That effort led to the automatic spending cuts that form part of the "fiscal cliff."

Just months later, in December 2011, Reid and McConnell were going through a tough fight over extending a payroll tax cut.

In both instances, it was resistance from conservative House Republicans that complicated efforts, just as is the case now with the "fiscal cliff."

Ravi Bhalla, New Jersey Democrat, Considers Endorsing Chris Christie

A Democrat raising funds to run for a New Jersey state Assembly seat has not ruled out endorsing the reelection of Republican Gov. Chris Christie.

Hoboken Councilman Ravi Bhalla (D) told PolitickerNJ.com that he would consider endorsing the first-term incumbent governor's 2013 reelection campaign, citing a need for local officials -- including himself and Mayor Dawn Zimmer (D) -- to have a good relationship with Christie. The governor enjoys a 72 percent approval rating.

"I'm not committed to any candidate," Bhalla told PolitickerNJ.com. "I think the governor is a formidable contender right now. The Democrats need a formidable contender. The governor has done great things for Hoboken. He's been an extraordinary partner with Mayor Zimmer. We want to make sure we have a strong relationship with the governor."

Bhalla, who lost an Assembly race in 2011, is raising funds to run for the state legislature again in 2013, and has scheduled fundraising events in New York and California. His favorable comments about Christie come amid rising tensions in the perennially fractured Hudson County Democratic Party, with some county Democrats engaging in public flirtations with Christie and other Republican leaders.

No statewide Republican candidate has prevailed in Hudson County since Gov. Tom Kean's (R) 1985 reelection that won 70 percent of the vote statewide. Republican Bret Schundler won three nonpartisan races for Jersey City mayor, but lost Hudson County in his 2001 gubernatorial bid.

State Sen. Brian Stack (D-Union City), who represents the same legislative district where Bhalla is seeking an Assembly seat, has been Christie's most prominent Democratic supporter in the state legislature. Stack, also Union City's mayor, described Christie in 2011 as "the greatest governor this state has ever had."

Jersey City mayoral candidate Steve Fulop (D) has come under fire from incumbent Mayor Jerry Healy (D) for a campaign fundraiser co-hosted by a prominent Republican operative. Assemblywoman Bonnie Watson Coleman (D-Ewing Township), a former state Democratic Party chairwoman, called Fulop's Republican backing "frightening." Fulop's spokesman has said the Republican operative, Brian Nelson, was not a co-host, but rather "a decade-long friend." Nelson described himself as a co-host in an email invitation to the fundraiser. Healy also received GOP backing in his past campaigns.

State Sen. Barbara Buono (D-Metuchen) is the only announced Democrat gubernatorial candidate, but state Senate President Steve Sweeney (D-West Deptford) and Elizabeth Mayor Chris Bollwage (D) are exploring candidacies. Newark Mayor Cory Booker (D) said last week that he would not run for governor this year, and instead would seek a U.S. Senate seat in 2014.

In order to tackle this double issue of improving access to energy and meeting growing energy needs, there needs to be an adoption of more sustainable energy practices worldwide, which focuses not only on the economics of energy resources but also takes additional critical factors into consideration, namely the impact on the environment, especially on climate change.

What steps must be taken? The problem is two-pronged: the amount of renewable energy generation must be increased, but simultaneously, energy consumption needs to be reduced, including through increased energy efficiency. As energy use in developing countries increases even more rapidly, this growth will provide an opportunity for the deployment of new clean energy sources, as well as the creation of new, more efficient energy infrastructure.

Managing Alternatives

When considering energy alternatives, there are three main aspects that come into play: economic competitiveness, energy security, and environmental impact [2]. Unfortunately, due to the high cost of many sustainable energy technologies, economic competitiveness often takes precedence, especially in areas with limited resources. But since we know that climate change affects us all, we must find a way to a sustainable energy future in both developing and developed nations. How then can we provide low and middle-income countries with the resources to switch to a sustainable energy future? Two crucial factors ? financing mechanisms and further technological developments ? will be required to make clean energy systems economically competitive with traditional fossil-fuel burning technologies. Financial mechanisms allow for a reduction in some market barriers for new, clean energy technologies by providing investors with less risk and uncertainty when competing with traditional energy sources, while continuous technological development could produce applications that are adapted to local conditions, as well as allow the establishment of new ?clean industries? that could provide economic development for these developing countries.

The international community has created a number of financing mechanisms to transfer resources from wealthier countries to developing nations, many of them as a way for developed nations to comply with their own emission reduction targets under the Kyoto Protocol. Examples of such efforts include the Clean Development Mechanism (CDM) and the Joint Implementation (JI) plan, and the program for Reducing Emissions from Deforestation and Forest Degradation (REDD) [3]. However, these programs depend on a carbon market to fix the price of carbon emissions, which has not yet been a successful model due to the volatility in the price of carbon in the market?s current implementation, and in recent years the price has been too low to encourage investment in clean technologies via these types of mechanisms. Moreover, these mechanisms have suffered from a range of shortfalls and criticisms, ranging from fraudulent project approvals, unintended harmful consequences to the environment, and failure to consult local communities and indigenous populations most affected by the financed projects [4,5]. Because of these flaws, these programs have yet to succeed in facilitating the widespread implementation of truly sustainable energy development, but ongoing changes to these programs might help address some of these issues.

Local Solutions

At a national or local level, there are many models being used around the world to encourage the deployment of clean energy technologies, many of which have high upfront capital costs and are not yet price competitive with conventional fossil fuel technologies, and so provide less of an incentive for the private sector to invest [6,7]. Some of these models reduce the high capital associated with implementing sustainable energy projects, while others increase the benefits received from sales of clean energy. We could call the first ones ?supply incentives? and the second category ?demand incentives?. Supply incentives may come in the form of subsidies, grants, or tax breaks that benefit the installation of renewable energy technologies, whereas demand incentives ensure a premium payment for the energy that comes from cleaner energy sources. The most commonly used form of the latter is a Feed-in Tariff (FIT), which contractually guarantees a price for the energy proportional to its cost of production [8]. Another interesting model, which has proven successful in many developed countries and has also been implemented in developing countries with the aid of the World Bank, are Energy Service Companies or ESCOs. These companies are contracted to energy users to identify energy savings projects, and are then paid from the energy savings that come from the financed projects. Countries that have implemented this model include Brazil, China, India, Thailand, Turkey, Uruguay, and Vietnam [6].

Another critical issue in most nations is the case of misplaced subsidies, where the government subsidizes fossil fuels in an attempt to reduce the economic burden of international prices. These subsidies make it even harder for renewable technologies to compete. Reallocation of subsidies to cleaner sources of energy would allow an easier adoption of these technologies instead of perpetuating the consumption of fossil fuels.

It is worth mentioning that renewable technologies may be more easily implemented in rural ?off-grid? areas. In these locations, the lack of infrastructure for conventional energy sources may make it more cost-effective to install local renewable energy systems [9]. An interesting example of this is found in the African country of Senegal, which chose to seek alternatives to diversify their energy supply, exploring the possible addition of renewable energy into their energy portfolio, ways to encourage an increased share of energy produced from renewable sources, and feed-in-tariffs both for off-grid solar and wind [9] . Examples of these projects include small-scale solar photovoltaics aimed at providing a regional supply of energy to charge cellphones, solar lamps to phase out kerosene lamps, small solar ovens to provide an alternative for cooking, or in regions more abundant in water resources, micro-hydro electricity generation projects.

In addition to meeting energy demands in growing economies, the implementation of new technologies itself has the potential to increase the a country?s economic development, as new industries are created and with them new jobs, while facilitating domestic innovation and technological advances [1,10]. Moreover, improved access to sustainable sources of energy could promote social development, for example through the empowerment of women by freeing them from the laborious task of accruing traditional sources such as firewood [11].

Conclusion

It is clear that no single approach will allow the switch from cheaper conventional energy technologies to cleaner and more sustainable ones in developing countries, yet with international coordination, government policies to level the playing field for renewable energy, and participation of the private sector, it is possible to foresee a future for sustainable energy in the developing world. Which strategy should be adopted to aid the implementation of sustainable energy would likely vary from country to country, as their fiscal, social and geographical conditions may favor different means, but the important thing is that they start developing these policies now.

We must also recognize that today?s developed nations industrialized in an unsustainable way and therefore have an important role in aiding the deployment of renewables in currently developing countries. The transfer of resources, funds, and technological knowledge from developed countries is a crucial part of sustainable energy deployment in the developing world, and must be a collaboration involving research, business, venture capital, and government organization in both groups of countries [12]. A great example of this is the US-China Clean Energy Research Centre (CERC) (http://www.us-china-cerc.org/). This approach of technological and financial transfer may be the most promising in promoting sustainable energy, and could allow both developed and developing countries to find common ground in balancing environmental protection mutual socioeconomic development.

Samsung Galaxy S4 Projected Keyboard - Business Insider

The video below from Rozetked purports to show a "rendering" of Samsung's forthcoming Galaxy S4 smartphone, which is poised to leapfrog the iPhone 5 when it comes out next year.

(Translation: The phone and features in the video are not actually the S4).

There are two cool features in the video:

First, the phone is thin and the screen is big. Many of those who own iPhones secretly covet the larger screens on Samsung phones, and this screen is big. And the rendered phone is thinner than the iPhone 5.

Second, the phone includes a "projected keyboard" feature in which the phone projects an image of a keyboard on a flat surface and then allows the user to type on the projected keys. If that is real and it works, that will be cool. Much cooler than carrying around an external keyboard.

The real Galaxy S4 is expected to come out early next year. The fear of many Apple fans is that, now that Samsung has basically caught up with Apple on the smartphone front--the Galaxy S3 is an excellent phone that some people prefer to the iPhone--this new phone will vault past the iPhone 5 and leave Apple scrambling to catch up.

RE: The ?Water Squeeze? article by Jeff Thomas in the December, 2012 issue:

I am more than a little outraged at the casual tone taken by NPIC Operations Manager Steve Smith when he commented, ?I think the farmers, if they are astute about this situation ? given the drought ? they will probably cut back on the number of acres they are irrigating.? I would have expected this sort of comment out of a City official, for example when City of Fort Collins Water Resources Manager Donnie Dustin announced that Fort Collins will almost certainly have water restrictions in place in 2013. Almost certainly?

Farmers rely on water to irrigate crops that pay their wages and make their living. Farmers do not water their lands to make them look pretty. Simply cutting back on the number of irrigated acres is NOT a solution or a viable option. Without water on the vast acres in and around Larimer County, the land turns to dust. Farmers losing their lands and livings results in a local depression of the economy ? initially. The final result, of course, is that there are no more farms and no more food. Land does NOT equal farmable land. Farming CANNOT happen without water. Eating CANNOT happen without farming.

When the cities are restricted to necessary water usage, ONLY then should agricultural water be effected ? ESPECIALLY in Larimer County, Colorado.

The following has been taken from the Executive Summary of ?A Right to Farm Policy? adopted Sept. 2, 1998, found on the Larimer County Website:

?It is the policy of the Board of County Commissioners of Larimer County that ranching, farming, and all manner of agricultural activities and operations within and throughout Larimer County are integral elements of and necessary for the continued vitality of the County?s history, economy, landscape, open space, lifestyle, and culture.

Given their importance to Larimer County, Northern Colorado, and the State, agricultural lands and operations are worthy of recognition and protection.
Because, by law, Colorado is a ?Right-to-Farm? State, residents and visitors must be prepared to accept the activities, sights, sounds, and smells of Larimer County?s agricultural operations as a normal and necessary aspect of living in a county with a strong rural character and a healthy agricultural sector.

People with urban expectations may perceive agricultural activities, sights, sounds, and smells as inconvenient, an eyesore, or unpleasant, however, state law and county policy provide that ranching, farming, or other agricultural activities and operations within Larimer County shall not be considered to be nuisances so long as operated in conformance with the law and in a non-negligent manner.

Residents and visitors must be prepared to encounter noises, odors, lights, mud, dust, smoke, chemicals, machinery and livestock on public roads, storage and disposal of manure, and the application of chemical fertilizers, soil amendments, herbicides, and pesticides, by spraying and other mechanisms.

All landowners, whether agricultural business, farm, ranch or residence, have obligations under state law and county regulation. For example they must maintain fences and adhere to open range laws which say livestock must be fenced out.
Irrigators have the right to maintain irrigation ditches through established easements that transports water for their use. Irrigation ditches are not to be used for the dumping of refuse.

Landowners are responsible for controlling weeds, keeping pets under control, using property in accordance with zoning, maintaining the environmental resources of the property wisely.

Residents and visitors are encouraged to learn about these rights and responsibilities and act as good neighbors and citizens of Larimer County.

The Board of County Commissioners shall establish a dispute resolution procedure with mediators to informally resolve conflicts that may arise between landowners or residents relating to agricultural operations or activities. When rural residents cannot come to an agreement or understanding about fences, ditches, livestock, or other agricultural issues, this may be the forum used to resolve disputes.

Mediators must be knowledgeable, solution oriented, and at least one such mediator in each dispute must be directly involved in agriculture or an agricultural producer must serve in an advisory role to the trained mediator.?

This is an agricultural community. Let?s act like we support the agriculture that actually happens here.

Sergei Magnitsky Case: Prosecutors Drop Accusations In Death Of Whistleblower

MOSCOW, Dec 24 (Reuters) - Russian prosecutors on Monday dropped their accusations against the only person being tried in connection with the prison death of anti-corruption lawyer Sergei Magnitsky, asking a court to find a former prison official not guilty.

The surprise move in the trial of Dmitry Kratov came in the midst of a row between Moscow and Washington over U.S. legislation meant to punish Russians seen as linked to the death of Magnitsky and other alleged human rights violations.

If the court clears Kratov, a former deputy head of a jail where Magnitsky spent part of a year, it will fuel accusations by Kremlin critics that the Russian government has no intention of seeking justice in a case that has blackened Russia's image.

"We have not determined what happened, and the biggest tragedy here is that ... this may have been our last chance to ask questions" of people who may have been involved, said Dmitry Kharitonov, a lawyer for Magnitsky's widow and family.

U.S. President Barack Obama on Dec. 14 signed a law known as the Magnitsky Act, which directs his administration to bar accused Russian human rights violators from entering the United States and freeze any assets they have in U.S. banks.

Russia is retaliating with a bill expected to be approved by the upper house of parliament this week. It would apply similar measures to Americans accused of violating the rights of Russians and also bar Americans from adopting Russian children.

Magnitsky died in November 2009 after nearly a year in jail - the victim, former colleagues say, of retribution from the same police investigators he had accused of stealing $230 million from the state through fraudulent tax refunds.

His death caused an international outcry and Kremlin critics said it underscored the dangers risks run by Russians who challenge the authorities. The Kremlin's own human rights council said Magnitsky was probably beaten to death.

ROLE REVERSAL

Dmitry Medvedev, Russia's president at the time, fired several senior prison officials and ordered a investigation, but Kratov, charged with negligence, is the only person now on trial or facing trial in connection with his death.

State prosecutor Konstantin Bokov told the court there was no direct link between the actions of Kratov - who he said followed the rules of his job and had never received a health complaint from Magnitsky - and the lawyer's death.

The court is expected to rule on Friday on Kratov's guilt or innocence.

Kharitonov said a guilty verdict was still possible but unlikely, and he accused the prosecutors of avoiding testimony by several witnesses by saying last week that there was enough evidence for a guilty verdict and speeding the trial to an end.

"The prosecutors essentially defended Kratov, rather than prosecuting him," he said in an interview on cable TV and internet channel Dozhd.

He said he believed Russian prosecutors want Kratov cleared to avoid any suggestion they themselves are culpable in the death of Magnitsky, which occurred after prosecutors backed efforts to keep him in jail on tax evasion charges.

Kharitonov said the prosecutors also wanted to ensure they were on the right side in the conflict over the new U.S. law.

"The easiest thing for the prosecutor's office to do is to say that nobody is guilty - and if nobody is guilty, then why is the Magnitsky Act needed?" the lawyer said.

He said Magnitsky's family would demand that the state continue investigating his death.

I installed some speed reading apps and tested them. I?ve so far notices a few ?categories? or groups of equals:

  • One kind exists mostly from showing a text word by word in the middle of the screen. Showing each word a very short time and so you can read at a high wpm because you never need to move your eyes.
  • Another kind is merely a speed reading article disguised as app.
  • Another kind is no speed reading app but just a reading app with a fancy name.
  • Yet another kind is training in the form of news/actually.
  • And the last kind is a training app, not for your own stuff but purely for training.

I only tested them quickly and unions talked the non-interesting. But they aren?t quite what I?m looking for. Maybe I should write one myself for training and guided reading.

Cowboys-Redskins Game Flexed To 'Sunday Night Football'

NEW YORK (AP) ? The Dallas Cowboys-Washington Redskins game that will decide the NFC East is moving to prime time.

The NFL says that Dallas' matchup with rival Washington on Dec. 30 would be on NBC's "Sunday Night Football."

Starting in Week 11, the league's flexible scheduling policy allows it to move a more appealing game to Sunday night. This is the second time this season a switch has been made.

The Cowboys are 8-7 heading into their trip to Washington, which beat the Cowboys 38-31 on Thanksgiving. The Redskins are 9-6.

Another matchup with playoff implications, Packers-Vikings, shifts to 4:25 p.m. EST on Fox.
