NEW YORK (Reuters) ? Commodity-related stocks drove Wall Street lower on Wednesday as stiff declines in energy and metals prices underscored investor concerns about global economic weakness and Europe's raging debt crisis.

A sharp 7 percent dive in the price of copper, seen as a leading indicator for the economy, rattled investors and led to a drop of 4.5 percent in the S&P materials index. Freeport-McMoRan Copper & Gold Inc fell 7.3 percent to $32.29.

Investors were on a knife edge as inspectors from the EU and IMF headed to Greece to scrutinize austerity plans while German Chancellor Angela Merkel worked to defuse a revolt within her government ahead of a vote to expand Europe's bailout fund on Thursday.

Wednesday's declines put the S&P 500 on course for its worst quarter since the high noon of the financial crisis in the fourth quarter of 2008. The drop also illustrates how sensitive the market has become to news on Europe's troubles.

"There is certainly a lot of headline risk and a lot of weak hands that hold stocks after this big rally we've had in the last three days," said Robert Francello, head of equity trading for Apex Capital, a hedge fund in San Francisco.

"Traders who have either gotten long during the rally or covered their shorts are probably going just to flatten themselves out, either taking profits or getting out of the market," he said.

Brent crude resumed its downward trend, falling more than $3 in afternoon trade, sending an S&P index of energy stocks down 3 percent. Chevron fell 1.9 percent to $91.74.

News early in the afternoon that bans on short-selling stocks in France, Italy and Spain have been extended highlighted the regulatory risk faced by investors and increased selling pressure.

The Dow Jones industrial average dropped 179.79 points, or 1.61 percent, to 11,010.90. The Standard & Poor's 500 Index dropped 24.32 points, or 2.07 percent, to 1,151.06. The Nasdaq Composite Index dropped 55.25 points, or 2.17 percent, to 2,491.58.

Traders said volume would likely be light and market movements accentuated during the rest of the quarter due to the Jewish New Year holiday of Rosh Hashanah.

So far, the S&P 500 has fallen 12.8 percent this quarter, its worst decline since the fourth quarter of 2008 when it fell 22.6 percent.

In the commodities sector, Cliffs Natural Resources Inc sank 8.4 percent to $55.66. Gold prices fell more than 2 percent.

"It's fear of a global slowdown," said Wayne Kaufman, chief market analyst at John Thomas Financial in New York. "It's a pure flight to safety into the dollar here, and that's killing commodities."

A push to solidify a euro-zone rescue fund and alleviate the region's sovereign debt crisis lifted stocks on Tuesday for a third consecutive session, following four straight days of losses for the benchmark S&P 500. The S&P gained more than 4 percent over that three-day period.

Amazon.com Inc gained 2.5 percent to $229.71 after it unveiled a new tablet computer with a $199 price tag. Apple Inc, which makes the popular iPad tablet, fell 0.6 percent to $397.01.

Microsoft Corp dipped 0.4 percent to $25.58 after Samsung Electronics Co Ltd unveiled software pacts with the company.

In earnings news, Jabil Circuit Inc advanced 8.2 percent to $18.81 a day after reporting fourth-quarter earnings that beat expectations, while Family Dollar Stores Inc fell 1.6 percent to $53.31 after its results.

In economic news, orders for long-lasting U.S. manufactured goods slipped in August on weak demand for motor vehicles, but a rebound in a gauge of business spending suggested the economy would avoid another recession.

About five stocks fell for every one that rose on both the New York Stock Exchange and the Nasdaq. About 7.96 billion shares traded on the New York Stock Exchange, the American Stock Exchange and Nasdaq, in line with this year's average.

Doomed satellite: Where and when will it plummet to Earth?

It is still too early to tell exactly where the dead satellite will fall. Scientists will likely have a much better idea of where the debris will land about two hours before the impact, NASA officials said.

A dead NASA satellite will plummet to Earth on Friday (Sept. 23), and while the U.S. space agency doesn't know exactly where pieces of the massive spacecraft will hit, one thing is certain: North America is in the clear.

NASA's Upper Atmosphere Research Satellite, or UARS, is set to make an uncontrolled re-entry into Earth's atmosphere on Friday. However, it is still too early to tell exactly where the 6.5-ton spacecraft will fall. Scientists will likely have a much better idea of where the debris will land about two hours before the impact, NASA officials said.

But, NASA was able to rule out North America as being in the potential debris drop zone.

"Re-entry is expected sometime during the afternoon of Sept. 23, Eastern Daylight Time," agency officials said in a statement. "The satellite will not be passing over North America during that time period. It is still too early to predict the time and location of re-entry with any more certainty, but predictions will become more refined in the next 24 to 48 hours."

In the meantime, NASA and the U.S. Air Force will be closely monitoring the satellite and its decaying orbit.

"With re-entry we're always interested in day-by-day and hour-by-hour details," Mark Matney, a scientist with NASA's Orbital Debris Program Office, told SPACE.com. "It's very difficult to predict how it's going to happen. With our models, we try to figure out what parts of the spacecraft ? what materials ? will interact with the atmosphere in terms of temperature and melting, and determine which of those will survive. Wide range of possibilities

Current predictions of the potential impact zone cover a giant swath of the planet ? anywhere between the latitudes of northern Canada and southern South America. Scientists will be able to refine these projections as the spacecraft makes its fiery journey through the atmosphere.

"It's partly a matter of not knowing enough," said Ray Williamson, executive director of the Secure World Foundation, an organization dedicated to the peaceful use of outer space. "The shape of the structure is not perfectly spherical, so when it heats up and starts to break up, it will break into odd pieces. Once it begins to break up, then they can get a better sense of where this is roughly going to hit."

Scientists at NASA's Orbital Debris Program Office estimate that at least 26 large pieces of the bus-size satellite will endure the scorching heat of re-entry. Approximately 1,170 pounds (532 kilograms) of material are expected to reach the ground, NASA officials said.

These pieces of debris will likely be scattered over a 500-mile (804-kilometer) long path. But agency officials have been quick to stress that there is very little chance that satellite chunks will smash intotowns or cities. [Amateur Astronomer Photographs Doomed Satellite]

Instead, it's much more likely that the debris will fall over water or remote, uninhabited areas, NASA officials said.

"There's always a concern," Matney said. "But, populated areas are a small fraction of the Earth's surface. Much of the Earth's surface has either no people or very few people. We believe that the risk is very modest."

Odds of human injury very low

For comparison, when NASA's space shuttle Columbia tragically broke apart during re-entry in 2003, debris from the 100-ton spacecraft was scattered across Texas, but did not damage any structures or injure any people.

"When [Columbia] came back, as the shuttle heated up, it broke into pieces ? some of them very large, and some very small," Williamson said. "Even then, there was difficulty in trying to find the pieces that were spread over such a large area. It was such an unpopulated area that it was very difficult to locate all the pieces, even though they knew from videos pretty much precisely the track that it followed across the atmosphere."

NASA has calculated the odds of anyone anywhere in the world being hit by a piece of the UARS satellite at 1in3,200. But, the chance that you personally will get hit is much more remote, on the order of 1inseveral trillion, Williamson said.

Still, if anyone happens to stumble upon a piece of the defunct satellite on the ground, agency officials stress that for safety and legal reasons, it is best to leave the material where it is, and alert the authorities.

"If you find something you think may be a piece of UARS, do not touch it," NASA officials said. "Contact a local law enforcement official for assistance."

(Nanowerk News) Can a flexible LED conformably placed on the human heart, situated on the corrugated surface of the human brain, or rolled upon the blood vessels, diagnose or even treat various diseases? These things might be a reality in the near future.

The team of Professor Keon Jae Lee (Department of Materials Science and Engineering, KAIST) has developed a new concept: a biocompatible, flexible Gallium Nitride (GaN) LED that can detect prostate cancer.

GaN LED, a highly efficient light emitting device, has been commercialized in LED TVs and in the lighting industry. Until now, it has been difficult to use this semiconductor material to fabricate flexible electronic systems due to its brittleness. The research team, however, has succeeded in developing a highly efficient, flexible GaN LED and in detecting cancer using a flexible LED biosensor.

Prof. Lee was involved in the first co-invention of "High Performance Flexible Single Crystal GaN" during his PhD course at the University of Illinois at Urbana-Champaign (UIUC). This flexible GaN LED biosensor utilized a similar protocol to transfer thin GaN LED films onto flexible substrates, followed by a biocompatible packaging process; the system's overall potential for use in implantable biomedical applications was demonstrated.

Professor John Roger (Department of Materials Science and Engineering, UIUC) said, "Bio-integrated LEDs represent an exciting, new technology with strong potential to address important challenges in human health. This present work represents a very nice contribution to this emerging field."

Child abuse rose during recession, research says (AP)

CHICAGO ? An increase in child abuse, mostly in infants, is linked with the recent recession in new research that raises fresh concerns about the impact of the nation's economic woes.

The results are in a study of 422 abused children from mostly lower-income families, known to face greater risks for being abused, and the research involved just 74 counties in four states. But lead author Dr. Rachel Berger of Children's Hospital of Pittsburgh said the results confirm anecdotal reports from many pediatricians who've seen increasing numbers of shaken baby cases and other forms of brain-injuring abuse.

Berger decided to study this type of injury, known as abusive head trauma, after noticing an increase at her own hospital from late 2007 through June 2009. Her hospital averaged 30 cases per year during those recession years versus 17 yearly before 2007.

Though this abuse is still uncommon, the number of cases in the counties studied increased sharply, rising from about 9 cases per 100,000 children in pre-recession years, to almost 15 per 100,000 kids during the recession ? a 65 percent increase.

By contrast, juvenile diabetes ? a better-known condition ? affects about 19 per 100,000 children younger than age 10.

Children studied were younger than 5, and most were infants. Most suffered brain damage and 69 died, though the death rate didn't rise during the recession.

Unemployment rates in the 74 counties rose during the five-year study. The proportion of children on Medicaid in those counties also increased, from 77 percent before the recession to 83 percent. However, insurance and family employment information were not reported for the abused children in the study.

Combine the stress of raising a young child with wage cuts or lost jobs and you get "a sort of toxic brew in terms of thinking about possible physical violence," said Mark Rank, a social welfare professor at Washington University in St. Louis. He said the study echoes sociological research linking violence with declines in economic well-being.

Along with U.S. Census data released last week indicating that a record 46 million Americans are poor, the study shows that "as poverty goes up and economic stagnation continues...there are really human costs involved," Rank said.

The study was released online Monday in Pediatrics.

The counties studied included Pittsburgh and western Pennsylvania; central and southern Ohio; and a handful of counties in northern Kentucky and in the Seattle area. The researchers examined medical records and national labor statistics for 2004 through November 2007 and compared them with data from the recession.

Of the 422 children diagnosed with abusive head trauma during the study, roughly 65 cases occurred each year before the recession, versus about 108 yearly during the recession.

Federal government data suggest that the recession did not affect child abuse rates. But the study authors said those numbers are based on reports from child protective services, not medical diagnoses, and did not address brain injuries specifically.

The research doesn't prove that the recession caused the abuse. Studying different regions and children from more middle-class families would help clarify if the recession really played a role, said Dr. Peter Sherman, director of the residency program in social pediatrics at Montefiore Medical Center in New York.

Sherman noted that most children studied were publicly insured even before the recession, suggesting that their families were already struggling financially.

Still, the recession affected many lower-income families, and Sherman said the study highlights "a very important issue."

Many of his patients are from poor families and abuse is not uncommon, he said.

He said pediatricians could help with prevention by asking families about difficulties paying for food or shelter and referring those in need to social service agencies. Sometimes just asking parents about stresses in their lives and acknowledging their struggles can help, he said.

Most parents who abuse young children aren't "ill-intentioned," he said. "Most of it is kind of just snapping...maybe being sleep-deprived and just losing it. It's something that can happen to anyone. Economics is just another stress" that can increase the risks, Sherman said.

In Maronda Homes, Inc. of Florida, et al, v. Lakeview Reserve Homeowners Association, Inc., the Supreme Court of Florida will soon determine whether common law implied warranties extend to the construction of common areas and facilities of a residential subdivision.

The Facts
After the turnover of control by the developer, Maronda Homes, the Lakeview Reserve community experienced drainage problems. Upon hiring an engineer to conduct an inspection, the Lakeview Reserve Association determined defects exist as to the paved streets, retention ponds, underground drainage pipes and grading of the site and lots. As a result of such defects, multiple lot owners allegedly experienced stagnant water, sinkholes, loss of grass, and erosion on their lots.?

The Association filed a complaint against Maronda Homes for breach of implied warranties of fitness for a particular purpose, merchantability, and habitability arising out of the alleged defective construction of the common area improvements. The Association claimed that the developer failed to construct the common areas properly to support a residential subdivision and the homes within it.?The trial awarded a summary judgment to the developer.?

The Association appealed to the Fifth District Court of Appeal. The Fifth District overturned the trial court by holding that implied warranties of fitness for a particular purpose, habitability, and merchantability apply to structures in common areas of a subdivision that immediately support the residence "in the form of essential services."?

The Fifth District's Analysis
In its opinion, the Fifth District analyzed the two major cases relied on by the developer,?Conklin v. Hurley?and?Port Sewall Harbor & Tennis Club Owners Association, Inc. v. First Federal Savings and Loan Association of Martin County.

In?Conklin, the Florida Supreme Court held that implied warranties of fitness and merchantability do not extend to first purchasers of residential real estate for improvements to land, other than the construction of a home and other improvements "immediately supporting the residence thereon, such as water wells and septic tanks."?

The Fifth District distinguished?Conklin?from?Lakeview Reserve?by pointing out that the buyers in the?Conklin?case were investors, but the?Lakeview Reserve?buyers represented by the Association were generally individuals who purchased the homes mainly for their own residential purposes. The Fifth District concluded that as permitting, construction and development have become more complex over time, the developer now is in a much more capable position to detect flaws and correct them during construction than the average homebuyer. The Court concluded that homebuyers are entitled to benefit from consumer protection public policy.?

The Fifth District then applied the?Conklin?language to the facts of?Lakeview Reserve?and came to a different holding than the Fourth District. In the?Port Sewall?case, the Fourth District held that common area roads and drainage in the subdivision failed to meet the?Conklin?test because the improvements did not pertain to the construction of homes and did not immediately support the residences. The Fourth District declined to extend the implied warranties to defects of roads and drainage areas.

The Fifth District announced a new test to determine what improvements immediately support the residence and thus are protected by an implied warranty:? if an improvement is providing a "service essential to the habitability of the home," then implied warranties apply. The Fifth District held that roads, drainage systems, retention ponds and underground pipes are essential to the habitability of the home and thus implied warranties apply. The Fifth District gave a list of examples of non-essential services, such as landscaping, sprinkler systems, recreational facilities, and security systems. The court said that these non-essential items "may be ugly, inconvenient, or uncomfortable" but they do not render a home uninhabitable. The Fifth District certified its conflict with the decision of the Fourth District in?Port Sewall, thereby asking the Florida Supreme Court to resolve the conflict.??

The Arguments Before the Supreme Court
Maronda Homes petitioned the Florida Supreme Court to answer the certified question: "Does the implied warranty of habitability apply to roadways and drainage structures in a residential subdivision?" ?The Supreme Court has accepted jurisdiction and initial briefs from both parties have been filed.?

Maronda Homes argues that the Fifth District's holding created policy decisions that should be made only by the Florida Legislature. Maronda Homes asserts that while HOAs are already extensively regulated, the legislature purposefully chose not to extend implied warranties to the common areas of HOAs, as it has done for condominiums. The developer argues that there is no need to improperly extend the implied warranty of habitability to common facilities when HOAs and owners have adequate remedies such as express warranties, negligence, or statutory warranties, when applicable. The developer also argues that the Association has no right to claim the benefit of implied warranties designed to protect the homeowners from damage to their homes.

The Association argues that the case should be dismissed because the Fifth District's decision does not directly conflict with the Fourth District's decision in?Port Sewall.?The Association also argues that the Fifth District properly concluded that HOAs have authority to sue for defects in common areas because of public policy to promote judicial economy. HOAs are obligated to accept ownership of common areas, but do not have any opportunity to bargain with the developer with regard to the property transfer and therefore need a remedy for defects caused by the developer. The Association also argues that the Fifth District got it right in furthering consumer protection by expanding implied warranties and asserts that it is appropriate for the Court to expand the?Conklin?rule to apply to common area facilities even though the Legislature has not adopted implied warranties for HOAs.?

Waiting on a Ruling
Once the final briefs are filed and argued, it will be up to the Florida Supreme Court to determine whether common law implied warranties should be expanded to apply to certain common area facilities. This could potentially impose an increased risk to developers, while providing Associations and homeowners additional remedies for defective subdivision improvements. This decision is significant as it may apply to the many relatively new developments in Florida as well as to those incomplete or as-yet-to be developed residential subdivisions.

Notwithstanding the Court's decision, proactive and open communication and due diligence is always suggested for both developers and HOAs prior to and during the turnover process in an effort to avoid or limit construction defect claims down the road.
